Terms and Conditions of Sale
1. Purpose
These General Terms and Conditions of Sale govern the sales of products offered on the website www.kokobrownswim.com. Any order placed on the site implies full and unreserved acceptance of these GTC.
2. Products
The products offered for sale are described and presented with the greatest possible accuracy. However, variations may exist due to their artisanal manufacturing; therefore, photographs are non-contractual.
3. Prices
Product prices are indicated in euros (€) for customers located in Europe and in US dollars (USD) for customers located outside Europe, all taxes included (excluding VAT and import taxes applicable in the customer's country) and excluding delivery costs. Any customs duties or local taxes remain the responsibility of the customer and are claimed by the competent authorities or the carrier upon import.
4. Orders
The customer validates their order by activating the "Pay" or "Validate" link and confirming the payment process. A confirmation email summarizing the order will be sent to the customer.
The validation of an order implies full and unreserved acceptance of these General Terms and Conditions of Sale.
KOKOBROWN SWIM reserves the right to cancel any order in case of a previous dispute with the customer or suspicion of fraud.
5. Payment
Payment is due immediately upon order. Accepted payment methods are: credit card (CB, Visa, Mastercard, American Express), Apple Pay, Google Pay, Link (Stripe) or in installments via Alma. Transactions are secured by STRIPE.
Installment payment with Alma:
• 2 installments: from €50 to €400
• 3 installments: from €100 to €400
→ No additional fees for the customer. Secure payment with 3D Secure.
The termination of the GTC between the seller and the customer results in the termination of the T&Cs between Alma and the customer.
6. Delivery
Preparation and delivery times are specified in the Delivery section of the website. KOKOBROWN SWIM cannot be held responsible for delays attributable to carriers or customs services. Products are shipped to the address indicated by the customer when placing the order. Areas served: France, European Union, and international shipping (Worldwide shipping). Delivery costs are indicated when placing the order.
7. Returns and refunds
In accordance with articles L.221-18 et seq. of the Consumer Code, you have a period of fourteen (14) days from the receipt of your order to exercise your right of withdrawal and request a refund.
Between fifteen (15) and thirty (30) days after receipt, you can request a store credit.
Initial delivery costs are not refunded.
Returned items must be:
- unworn, unwashed, and in their original condition,
- with tags and hygienic protection intact,
- stain-free (sunscreen, oil, makeup, etc.),
- odor-free (perfume, deodorant, detergent, sweat),
- in their original packaging.
For hygiene and safety reasons, swimwear will only be taken back or exchanged if these conditions are met.
Return shipping costs are borne by the customer unless otherwise stated.
Kokobrown Swim will refund the amount of the returned items within fourteen (14) days of their receipt, using the same payment method as used for the order.
8. Gift card
KOKOBROWN SWIM gift cards are valid for a period of 12 months from their issue date. They are usable exclusively on our website and can be used once or multiple times, until their balance is depleted. Gift cards cannot be refunded, either totally or partially, and cannot be exchanged for cash.
9. Liability
KOKOBROWN SWIM cannot be held responsible for damage related to improper use of the purchased product, non-compliance with care instructions, or in case of force majeure.
10. Legal guarantees
In accordance with articles L.217-4 et seq. of the Consumer Code and articles 1641 et seq. of the Civil Code, sold products benefit from:
- the legal guarantee of conformity allowing the customer to obtain the repair, replacement or refund of non-conforming or defective products,
- and the guarantee against hidden defects covering hidden defects of the product.
These guarantees only apply to defects existing at the time of product delivery.
They do not cover damage resulting from improper use, poor maintenance or normal wear and tear of the product.
11. COMMERCIAL OFFERS AND NEWSLETTERS
KOKOBROWN SWIM may send commercial offers to Customers by mail, email, SMS, telephone or via all web spaces managed by KOKOBROWN SWIM on social networks, subject to prior acceptance.
The Customer may at any time object free of charge to these commercial prospecting mailings by clicking on the "unsubscribe" link in each email.
12. Intellectual property
All elements of the site (texts, images, logos, design, products) are the exclusive property of KOKOBROWN SWIM and are protected by copyright and intellectual property laws. Any unauthorized reproduction or use is strictly prohibited.
13. Cookies
The site www.kokobrownswim.com uses cookies necessary for its proper functioning and, with your consent, analytical and marketing cookies to improve your experience. You can set or withdraw your consent at any time via the banner provided for this purpose.
14. Personal data
The personal data collected is used solely for order processing and communication with customers, in accordance with GDPR. You have the right to access, rectify and delete your data by writing to hello@kokobrownswim.com.
15. Applicable Law and Disputes
These terms and conditions are governed by French law.
In the event of a dispute, and after an attempt at amicable resolution, jurisdiction is attributed to the competent French courts.
16. Modification of the GTC
Given possible changes to the Website and regulations, KOKOBROWN SWIM reserves the right to modify the GTC at any time.
The new GTC will, where applicable, be brought to the Client's attention by online modification and will apply only to sales made after the modification.
